If you have had an accident then there is a chance that someone is liable. This liability is judged by the fact that the accident was someone's fault, if someone is to blame for your injury then you can make a claim. This can be an accident at work, a trip or fall at a supermarket or an injury sustained whilst walking down the street. There are many circumstances where your injury or accident may be the fault of another party.

The first step in making a no win no fee claim is to consult a personal injury solicitor. You need to speak to a reputable qualified solicitor who is familiar with this type of case. Your solicitor will ask you questions about the accident to determine the circumstances under which the injury was sustained.

If after talking to you the injury lawyer believes there is a valid case and the accident is the fault of someone else then they will start the claims process. A letter of claim will be sent to the defendant, the person believed to be at fault informing them that you intend to claim compensation for the injuries caused to you.

The no win, no fee claims process

At this stage a medical expert will be involved to assess the injuries that you sustained due to the accident. This may involve an examination or a review of any records that were created at the time you consulted your GP or doctor. You may have had to call an ambulance and be taken to accident and emergency in a more serious accident.

Your solicitor will then prepare what is known as a schedule of losses. The schedule of losses is basically a list of the financial claims you wish to make against the defendant due to lost earnings, future loss of earnings due to disability or distress and injury. Making these claims does not guarantee you will get them. A solicitor will be able to help you determine a realistic amount that you can claim.

At this point the defendant will be sent your list of claims which they will either accept or dispute. If the claim is disputed than the case will go to court and the outcome will be determined in court. If you lose the case you will not have to pay any costs as your case has been taken on a no win no fee basis.
