A personal injury claim can be made by anyone who has had an injury and who it can be proven that there was fault. If the injury is sustained by a child then the parent or legal guardian can start a claim on their behalf. Sadly some personal injury can result in death, in these circumstances the victims dependant can make a claim on there behalf.
To be able to make a claim in UK law the accident must have occurred within the last three years. If it is a child that is involved then the three year limit does not start until they legally become an adult at eighteen.
There are some circumstances where the three year rule has some exceptions. If you were injured at sea or whilst in an aeroplane then there is a two year limit instead of three. Personal injury can also come to light many years after the event without the victim even realising. Well known examples of this include the onset of lung disease in mine workers and many asbestosis cases. In these circumstances you will need to consult personal injury solicitors who can advise you on a possible case.
If you feel you may have a claim then you will need to start a claim under the supervision of a qualified solicitor. A solicitor with experience of personal injury claims and the practice they work for having a history of personal claims work would be beneficial. You will need to make an appointment, if your injury precludes you from travelling or getting to and from the office they will usually come to visit you in your home.
It is important to provide as much detailed information as you can, write down everything you remember about the accident. Were there any witnesses or even CCTV footage that would possibly be of help. You will probably be asked about any medical records so did you visit accident and emergency, was an ambulance called, did you visit your GP. The more information you provide the better a personal injury solicitor will be able to evaluate a potential claim and advise if your claim can be taken on a no win, no fee basis.
